Terms and Conditions


General Terms
PROPRIETARY INFORMATION, All written, electronic and verbal information provided by company in connection with performance of the assignment is considered valuable property of Company and will be kept confidential.

PRICE GUARANTEE, APSInfoTech.com will not increase the service rates for Company during the initial term of this agreement. The length of the term chosen by Company is in the TERM/TERMINATION paragraph of this agreement. During the initial term of this agreement if APSInfoTech.com lowers the rate for the same plan on its website (APSInfoTech.com) then APS InfoTech will lower the rates charged to Company to match the website rates and plans.

CHANGE OF PLAN, Company can change from its present plan to any other plan of APSInfoTech.com anytime during the contract period. The change of plan will be made effective from the next billing date and company agrees to pay the amount corresponding to the new plan chosen with effect from the date of change of plan. APSInfoTech.com does not charge anything for the change of plan to take effect.

CANCELLATION OF SERVICE: You may cancel the Agreement at any time by providing APS InfoTech with written authorization to cease the Service. Since all fees are payable in advance, in order to avoid charges for a subsequent billing cycle, you need to cancel the Service prior to the end of the current billing cycle. We recommend that you cancel your subscription (if relevant) prior to your next billing date, and also advise us of your intentions in writing prior to the end of your current billing cycle so that we know to cease providing the service, and then no further charges will be payable. You reserve the right to cancel the Service for any reason with prior notice of 30 days. We will not cancel the service from our part without notification of 30 days. If you are not completely satisfied with our service you can cancel within the first 14 days and APS InfoTech will refund your fees in full.


EMPLOYMENT SOLICITATION, Company, it's subsidiaries or affiliates shall not directly or indirectly solicit, employ, otherwise retain or refer to any entity or individual or any staff member of APSInfoTech.com for a period of one (1) year after termination of contract. APSInfoTech.com will not solicit, employ or retain any employee of Company.

SEVERABILITY, If any provision of this Agreement shall be held invalid or unenforceable, all remaining provisions shall continue to be valid and enforceable. Any provision held to be valid and enforceable by a court if such provision was limited, then that provision shall be deemed to be valid and enforceable as written or construed with those limitations effective.

WAIVER OF CONTRACTUAL RIGHT, Failure of APSInfoTech.com to enforce any provision of the agreement shall not be construed as a waiver or limitation of rights to enforce or compel compliance of any other provision of the Agreement.

RESPONSE TIME For Standard Technical Support, Billing Queries, and Sales Queries, we will use our best endeavors to respond to a minimum of 90% of Valid Queries within 30 minutes of the query being lodged, and to provide the relevant customer with an effective answer to their query within 6 hours of the query being lodged.

NOTICE: You agree to correspond with APS Infotech. If APS Infotech needs to contact you for any reason, we will do so via email, instant messenger or SMS. In emergency we can use phone to reach you. You agree to notify us promptly of any changes to your email address or other contact details.

CHANGES in Staff Any change in the staff, like increasing or decreasing or changing the tech should be notified with prior notice of 7 days.

NO THIRD-PARTY SUPPORT Unless we explicitly agree otherwise in writing, we will only provide support to your Direct Customers and not to customers of any other company/entity. For example, if you have multiple companies then you would need to purchase a separate Support staff for each company. We reserve the sole right to decide which customers are Direct Customers and which customers are not.

AGREEMENT, This is the Service Level Agreement between the parties, Agreement may be modified only in writing and when signed by both parties.
